General terms and conditions of sale

1° Scope of application
The general terms and conditions of sale (hereinafter referred to as "GTC") apply to all orders placed and contracts concluded (hereinafter referred to as "order") via the online store of LUXE DIFFUSION Sàrl, 1742 Autigny CHE-113.869.814, named www.gemology-cosmetics.ch. LUXE DIFFUSION Sàrl reserves the right to modify the GTCS. The version of the GCS valid at the time of the order applies. It cannot be changed unilaterally for the order in question.

2° Offer
The offer is intended for natural or legal persons who have their domicile or registered office in Switzerland or Liechtenstein. Products are only delivered to addresses in Switzerland or Liechtenstein.
The offer is valid as long as it appears in the online store and is subject to availability. Price and assortment changes are possible at any time. The images presented in advertisements, brochures, the online store, etc., as well as all product information (list of ingredients (INCI), values, allergen information, etc.) are for illustration purposes only and are not binding. The specific indications on the product packaging are decisive.

3° Price
Prices are in Swiss francs, including value added tax (VAT) and, if applicable, including advance recycling tax (ART).
The price indicated in the online store at the time of the order is authoritative. Additional chargeable services such as delivery charges, gift vouchers, discounts, etc. are shown separately in the shopping cart and on the invoice.

4° Order
The display of products in the online store is not legally binding. This is an online catalog presented for information purposes only, in order to invite customers to order the product through it. LUXE DIFFUSION Sàrl reserves the right to restrict delivery quantities for certain products and not to make the delivery if the order is particularly heavy or voluminous.
An order in this context is considered as a request to conclude a contract with LUXE DIFFUSION Sàrl.
A minimum amount applies to each order. The minimum amounts communicated in the online store apply. When ordering for the first time, the total amount of the shopping cart may not exceed CHF 2000.00 in case of payment by credit card.
After transmission of the order, the customer automatically receives an acknowledgement of receipt, which confirms that the order has been received at www.gemology-cosmetics.ch. The customer can no longer complete or cancel his order once it has been processed in our logistics center. If an order is completed, the original order serves as the basis for calculation, however, any special offers and discounts valid at the time of addition are not taken into account.
LUXE DIFFUSION Sàrl may, without justification, refuse all or part of the order. In this case, the customer will be informed and any payments already made will be refunded. Any other claim is excluded, in particular products that are not available are not delivered at a later date. Temporarily unavailable products cannot be reserved.

5° Conclusion of the contract
The contract is concluded after processing the order on the online shop www.gemology-cosmetics.ch of LUXE DIFFUSION Sàrl.

6° Delivery zone
The customer's delivery address must be in Switzerland or the Principality of Liechtenstein. If this is not the case, the customer will be redirected to the GEMOLOGY France website.

7° Delivery time
It is not possible to set a specific delivery date or time of delivery. Delays in time or blocking of a given delivery date are possible, in particular on peak days with an exceptionally high delivery volume, however, any claims for damages or other claims by the customer are excluded. No deliveries are made on Sundays or official national and cantonal holidays.
If the customer is not on site at the time of delivery, the goods are deposited in the post office box or letterbox, in front of the door of the house or apartment, or at the reception desk or in front of the entrance to the company. Insofar as the customer's mailbox belongs to a mailbox system, the deliverer shall deposit a collection notice in the mailbox. The customer shall then collect the delivery from the corresponding post office.
The customer shall be liable for the products delivered, even if he has not received them himself.

8° Delivery costs
Delivery costs depend on the weight and the chosen delivery method. The delivery charges stated in the online store apply. The delivery costs are shown in the shopping cart and on the invoice as an additional item.

9° Late payment
In case of late payment, LUXE DIFFUSION Sàrl is not obliged to accept new orders or to make pending deliveries. Until full payment of all amounts due, the customer cannot claim any compensation/credit for the period of validity.

10° Warranty
LUXE DIFFUSION Sàrl assumes the guarantee of freedom from defects of the products ordered until the expiry of the storage date, however a maximum of 2 years from the date of delivery. For products without a storage date, the legal period of 2 years from the date of delivery applies.
LUXE DIFFUSION Sàrl can offer a guarantee either with a partial or complete replacement by an equivalent product, with a credit note for a maximum amount corresponding to the sales price at the time of the order, or by granting a reduction.
There is no general right of return on products without defects and correctly delivered. The guarantee is explicitly excluded for products whose quality does not meet the customer's requirements.

11° Complaints
If products are delivered with visible damage to the packaging or contents, the customer must immediately notify the deliverer and refuse acceptance notwithstanding his warranty claims for defects. The customer must obtain a confirmation of damage from the supplier. All transport damage must also be reported immediately in writing (e-mail or letter) to LUXE DIFFUSION Sàrl.
In addition, the customer is responsible for immediately checking the ordered products on receipt and storing them correctly. In case of defects or deviations from the order, the customer must notify the customer service of LUXE DIFFUSION Sàrl on the day of delivery either by phone at +41 (0) 26 477 05 68 or by e-mail at boutique(at)gemology-cosmetics.ch. Thereafter, only hidden defects can still be the subject of a complaint and must be communicated immediately after their discovery to the customer service of LUXE DIFFUSION Sàrl. The amount paid by the customer for the defective goods is credited to the customer account. LUXE DIFFUSION Sàrl reserves the right to require proof of the defect.

12° Possibilities of payment
Payments must be made in Swiss francs.

13° Electronic means of payment
Accepted means of payment are credit cards (Visa, Mastercard, American Express), PayPal or bank prepayment. In case of payment by credit card, the payment will be debited after processing of the order in the online store www.gemology-cosmetics.ch by LUXE DIFFUSION Sàrl. Debit cards are not accepted.
In case of purchase on invoice with paying-in slip by post, invoices with all paying-in slips are sent to the customer in a single mailing. If the customer is in arrears with full or partial payment, all outstanding amounts in any form whatsoever are due immediately and LUXE DIFFUSION Sàrl can demand payment without delay. In case of late payment, LUXE DIFFUSION Sàrl is not obliged to accept new orders or to make pending deliveries.
In case of late payment, LUXE DIFFUSION Sàrl reserves the right to charge reminder fees and interest on arrears. All costs related to the settlement of overdue receivables are to be borne by the customer. In case of unsuccessful reminders, the invoiced amounts may be transferred to a collection company. The debt collection agency will assert the outstanding amounts in its own name and on its own account. It may charge additional processing fees and interest on arrears from the due date.

14° Refunds, credit notes, credit
If the customer is entitled to refunds or credit notes, they will be credited to the customer account and can be used for future purchases on www.gemology-cosmetics.ch. Vouchers may under no circumstances be sold or auctioned. Only one voucher can be used per order.

15° Applicable law and place of jurisdiction
Swiss substantive law applies to the legal relationship between LUXE DIFFUSION Sàrl and the client, to the exclusion of the provisions on conflicts of law and the Vienna Convention.
The place of jurisdiction for natural and legal persons is Fribourg.

16° Data protection
All personal data will be considered confidential. The information necessary for the management of the order will be subject to computer processing and may only be communicated to associated companies for the management of the order and financial follow-up. The data will not be sold to third parties.
